TERMS OF AGREEMENT

By entering into any contract or agreement with skdesignmedia.co.uk for our services including without limitation ordering any services through the skdesignmedia.co.uk web site (hereinafter referred to as your “Contract” with skdesignmedia.co.uk), you hereby agree to abide by, comply with and be legally bound by the policies, terms and conditions hereinafter set forth (these “Terms and Conditions”).

These Terms and Conditions are hereby incorporated by reference into your contract. To the extent that any provision of these Terms and Conditions conflicts with any provision of your Contract, the provision set forth herein shall be deemed amended so as to be consistent with the provisions of your Contract.

skdesignmedia.co.uk reserves the right to modify, amend, update and change these Terms and Conditions from time to time with notice via email or other means. You are responsible for regularly viewing these Terms and Conditions. You acknowledge and agree that skdesignmedia.co.uk shall not be liable to you or to any third party for any modification, amendment, suspension, discontinuance or other changes to these Terms and Conditions.

GRAPHIC DESIGN TECHNICALITIES

The graphic designed will have a pantone colour model. The source file will be .ai [Adobe Illustrator], which will be converted to curve and thus allow editing of size, colour etc but the fonts will be converted into paths/outlines/graphic objects.

Other formats sent will be:

• PSD (Layered Photoshop file in RGB for web editing)
• JPEG (150 dpi in full colour and grayscale)
• TIFF (CMYK Printable, 300 dpi)
• EPS (scalable file for printing)
• GIF(RGB colour and grayscale file with transparent background)

CLIENT PARTICIPATION AND SPECIFICATIONS AT START OF THE PROJECT AND THEREAFTER

By agreeing to this, you the client acknowledge that you have been given the opportunity to provide/describe what are considered initial specifications and guidelines for your web design and graphic design project. This is accomplished through an online form completion and a link will be sent to you by email together with the terms and conditions policy at the first page of the purchased. The form will include detailed and specific questions intended to assist the designer in their initial stage before the design work is commence. In any case where you the client/customer elect not to answer, or decline to provide details, you are acknowledging a wilful waiver of client input, and give your consent for the designer(s) to exercise full interpretation, being held blameless for any designs which may result, in the unfortunate event that the client is not satisfied. However we can also assists you as a customer to make a clear decision as to what you want us to do, we will also create a draft/mock-up where necessary before proceeding with the design work whether graphic design or web design project.

SCOPE OF PROJECT

The initial number of designs varies by project, and in no case may the client request additional new designs, in the event that they do not approve of the ones which were submitted and any further changes or edits will be charged at extra costs. The number of designs presented is presumed to have satisfied the initial number of designs as stated in the package description. In the event that the client requests additional designs, beyond the scope of their package (not including any unlimited revisions, which is a material change to an existing design, and not a redraw, and are not charged or considered to be redesigns), they are subject to additional charges of £50.00 per designer hour, prepaid in increments of three hour blocks or more can be discounted rates however must be agreed by both SK Design Media and client before making further changes/amendments. Any design requests outside of the specific stated scope or quote of the package are also subject to the same hourly charge or block payment depending on requirements, in prepaid one hour increments, and are non-refundable.

AFTER CARE SUPPORT

We offer 4 to 6 weeks after care support for free on all our web design services after completion of your website project however any extended support will be charged at extra costs. After this period we are not responsible for anything that happened to your website such as security, malware, updates on themes, plugins and other related issues to do with your website. We are not also responsible for updates of your theme, plugins and WordPress website or virus issues. Therefore if you want further assistance after the 4 to 6 weeks period is finished we will charge you to fix any issues relating to your website or you can pay a monthly support fee, click here for more details on pricing.

MANAGEMENT OF YOUR WEBSITE

After your free 4 to 6 week support period has expired and you want us to upload content, updates of your theme and plugins we will charge you extra depending on your requests. During your 4 to 6 weeks free support period and you need us to assist with issues relating to your website, we can show you how to upload content on your website, add images, upload posts and how to manage it including how to update plugins and themes, anything after this period will be additional charge. Within the 4 to 6 weeks period we will also assist you with any issues with your hosting, domain, security or technical problems or not able to access your website.

PAYMENT

You can decide to make full payments of all our services including web design and social media services however we offer instalment payments on selected services especially customers with higher package spends, please check with us first for instalment plan if necessary and we will provide you with alternative methods of payment. For customer wanting a payment plan option, 75% of the payment have to be made up front and this only applies to web design services and with higher package spends. We have many ways to make payment, payments can be made through online banking, PayPal, online transfer and other online payment gateway systems. Please also note that with instalment payments we will need the balance before we can complete the final project therefore you have to pay the balance before we can complete the work. skdesignmedia.co.uk shall be entitled, in its sole and absolute discretion, to withhold any services it is otherwise obligated to deliver or provide under your contract until such time as payments in full has been received. Therefore skdesignmedia.co.uk will notify you of any additional charges under your contract prior to commencing performance of its obligations there under.

DELIVERY AND ACCEPTANCE

Upon completion of your services in accordance with the Terms and Conditions set forth in your contract, skdesignmedia.co.uk will send you a draft by email or notify you with appropriate method of communications for you to review your project/work and feedback to us for final revision. skdesignmedia.co.uk will notify you via e-mail of such completion and delivery, and the manner in which you may access the draft/revision work for purposes of reviewing your service. You shall have 14 business days from the date of delivery of when we send you an email to notify skdesignmedia.co.uk in writing of your acceptance or rejection of the service. Your failure to notify skdesignmedia.co.uk in writing or other method of communications of your rejection of the service within 14 day period we shall constitute your acceptance of the service/work.

In the event you reject the service, you shall notify skdesignmedia.co.uk in writing or other means of your rejection within said 14 day period, including a detailed explanation for such rejection, following which skdesignmedia.co.uk shall use commercially reasonable efforts to provide a substitute or replacement of service as soon as practicable. Upon your written/email acceptance of the service, or any substitute or review of service, skdesignmedia.co.uk shall release and deliver the same to you  in a manner that both parties are agreed with the work completed. Again please note that this only applies to web design services. As for graphic design or our other services, any issues or changes can be solve with 7 days. For hosting and website services please refer to the terms and conditions of each services and their pricing packages as this will tell you what you will be paying for as part of your package. This project will be determined to be closed if we do not have written, phone or online contact within 14 days from the last revision. The project may be re-opened only upon skdesignmedia.co.uk discretion.

NUMNER OF EDITS

Number of edits depends on the packages that you take on with us. The number of revisions and edits is based on your project package, customer with higher package spends will receive more edits as well as the number of weeks for after care support. Therefore, before agreeing to make payment please make sure you read our terms and conditions, have all your information and content ready, be clear on what you want and make sure all available information including text, images/graphics and videos if applicable are ready. Any further edits will be charge at extra costs, also if all information and content is not available whereby we have to do the research on the information to add as part of your designing process you will be charge extra for such service.

REFUND POLICY

We guarantee you 100% satisfaction with our web design, graphic design work or any of our other services therefore no refund is available once work has started, you have up to 24 hours to cancel after payment has been made before we start work. Refund will only apply if work haven’t started yet however we will take 10 percent off for administration/service fee. There are No Refunds for Custom Packages and we require 75 percent project amount as up-front deposit for any package that you select.

EXERCISING REFUND PROVISION

If, upon being presented with the INITIAL graphic or web design project, the client elects not to pursue the project any further, and request a refund, this should be in writing by email to support@skdesignmedia.co.uk, a refund in accordance with the terms of this website will be issued.

A Refund will be issued upon request, EXCEPT in the following cases:

• Refund requests has past the 24 hour period before we start work.
• Refunds do not apply if we do not hear back from you for more than a week after completing initial designs (Project is considered closed after inactivity of 14 day period)
• Refunds do not apply to projects that have requested any changes and/or alterations to a chosen sample.
• Refunds do not apply if you have approved a design or web design project.
• Refunds do not apply to upgrades and/or additional services provided and displayed to the client.
• Refunds do not apply to slogan production, mock-up and/or ideas.
• Refunds do not apply to projects that include Calligraphy / Illustrative Design concepts in the initial designs.
• Refunds do not apply if client has made any request which is out of scope or not properly defined in the initial description which was provided at the time of completing order form.

HOW  WILL THE MONEY BE TRANSFERRED

If you have paid using your credit card – the money will be transferred back to your credit card account. It may take up to 3 to 7 business days before the money can appear on your account.

PROPRIETARY RIGHTS

You represent and warrant that you are the owner of or have the exclusive right to use any and all proprietary information you provide to skdesignmedia.co.uk in furtherance of or in connection with your contract, including without limitation any and all trade names, trademarks, copyrights, graphics, artworks, designs, logos and similar materials or information.

skdesignmedia.co.uk makes no representation or warranty that it has the exclusive right, title and interest in and to the services provided to you or that such services do not and will not infringe on the intellectual property or proprietary rights of any third party. skdesignmedia.co.uk will not take any action in furtherance of protecting the services to be delivered under your contract, and will deliver the same “as is” and without any representation or warranty as to your ability to use such services or to obtain trademark, copyright or similar protection of such services. skdesignmedia.co.uk retains and reserves the perpetual, royalty-free right to use any and all services developed by skdesignmedia.co.uk for display and self-promotional purposes, regardless of your acceptance and skdesignmedia.co.uk’s delivery of the same to you.

TERMINATION

skdesignmedia.co.uk reserves the right, in its sole discretion and for any reason whatsoever, to reject, cancel or terminate, permanently or temporarily, your order for any services offered by skdesignmedia.co.uk, your contract and/or your access to the skdesignmedia.co.uk web site, at any time and without prior notice. You agree that skdesignmedia.co.uk shall not be liable to you or any third party for any rejection, cancellation or termination of your order, your contract or your access to the skdesignmedia.co.uk web site. In the event that skdesignmedia.co.uk rejects, cancels or terminates your contract or your order for a reason other than your breach or non-performance under your contract, skdesignmedia.co.uk will return any amounts prepaid by you relating to the rejected, cancelled or terminated contract or order.

DISCLAIMER OF WARRANTIES:

You hereby expressly acknowledge and agree that the information, software, codes, services, text, graphics or other items and materials provided or made available by skdesignmedia.co.uk are provided “as is” without any express or implied warranty of any kind.

To the fullest extent permitted by law, skdesignmedia.co.uk hereby disclaims all implied warranties of any kind, including without limitation warranties of merchantability, suitability, infringement of intellectual property rights, or fitness for a particular purpose. skdesignmedia.co.uk makes no warranty that its services will be provided in a timely and secure manner, or without errors or defects, or that its services will not infringe on the intellectual property or proprietary rights of any third party. skdesignmedia.co.uk does not warrant that the results obtained from your use of the services provided by skdesignmedia.co.uk will meet your expectations.

COPYRIGHT AND TRADEMARK NOTICES

All intellectual property of skdesignmedia.co.uk, including all web site screens and portions thereof, graphics, original text elements, site design, logos, pictures and icons, as well as the selection, format and organisation thereof, constitute proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as expressly authorised by skdesignmedia.co.uk in writing or otherwise required by applicable law, any rent, lease, sale, modification, duplication, distribution, alteration, retransmission or publication of any intellectual property or proprietary information of skdesignmedia.co.uk is strictly prohibited.
